Show moreAfter the calamitous and environmentally devastating occurrence of the Deepwater Horizon Oil Spill in the Gulf of Mexico in 2010, the sobering realities of the United States' failure to successfully protect its ocean waters have caused several modifications in policy, legislation, and overall direction ofthe entire nation. Although there has been a general shift towards ecological safety and away from the pursuit to drill, oil-drilling explorations have continued to take place in international waters. This research will focus on the future operations of Repsol YPF, S.A., a Spanish oil company stationed in Cuba, whose drilling ambitions have caused a myriad of problems for the United States. The intent of this paper is to investigate the legalities surrounding Cuba's forthcoming deepwater oil drilling plan within the Florida Straights and how the existing relations between Cuba and the United States will shape the outcome. The majority of United States officials, senators, and policymakers are experiencing a great deal of anxiety and apprehension as Cuba's oil drilling plan continues to solidify. Recent changes in legislation and congressional opinion display the United States' overall objective to shape the manner in which the drilling operations will be carried out. This thesis will ultimately explore what progress the United States has made thus far in the sector of dialogue with Cuban officials, the various options the United States could seek in regards to taking part in the drilling operations that will soon commence in Cuba, and the current risks involved with the entirety of the drilling endeavor.

Show moreRecently, numerous high-profile instances of police misconduct and corruption have been thrust into the national spotlight. Hiring police officers who will act with integrity and not betray public trust remains essential. The present research experimentally examines this phenomenon by evaluating pre-employment assessment results against applicant performance on a simulated cheating task (i.e., The Dots Task) in order to derive information to improve contemporary pre-employment screening and selection models. Four case examples are presented which depict malicious actors who possessed privileged access, assumed no one would ever scrutinize their activities, and attempted to leverage a lack of oversight for their personal benefit. A literature review of previous research findings is presented, and results from the current study are discussed. Spearman correlation analyses consistently indicated that participants who cheated were predisposed to moral disengagement via advantageous comparison. Participants who left all or part of their monetary award were less prone to general moral disengagement, particularly displacement of responsibility, while the opposite effect was observed for participants who took more than their earned award. Impression management was positively associated with stealing extra money, and cheating was more common among participants with elevated distorted thought patterns, including obsessional thinking, paranoid ideation, and alienation/perceptual distortion. Stepwise linear multiple regression analyses further substantiated the relationship between cheating and both distorted thought patterns and impression management, as well as provided evidence that (1) internalizing morality as part of one's self-identity and (2) warmth act as protective factors against cheating behavior. Positive relationships between cheating and distortion of consequences were also present within multiple regression analyses. Behavioral models produced from stepwise linear multiple regression analyses offer the potential to predict the likelihood and severity of cheating behavior that an individual may be predisposed to commit based upon their pre-employment assessment data, thereby enhancing pre-employment screening and selection decisions.

Show moreWrong-way driving (WWD) is a hazardous behavior on interstates, toll roads, and other high-speed limited access facilities. Since WWD crashes are rare, recent researchers have studied WWD events such as WWD 911 calls and WWD citations to understand the overall nature and trend of WWD. It is very difficult to build credible statistical models based solely on crashes due to the small sample size since these are only 3% of all crashes. Modeling of WWD non-crash events can result in more accurate models. A model was developed for Florida limited access facilities to identify roadway factors and traffic characteristics of exit ramp terminals that influence WWD entries. This model indicated that interchange type, intersection angle of exit ramp terminals, presence of tolling at the entrance ramp, presence of channelizing island between the exit ramp lanes, number of lanes on the exit ramp, area (rural or urban), and traffic volumes significantly affect the likelihood of WWD entries at exit ramps. Conventional (")Wrong Way(") signs can reduce WWD incidents but can be insufficient in some cases. In areas with many WWD crash and non-crash events, transportation agencies can be proactive by considering the use of countermeasures with advanced technologies to actively warn motorists of WWD violations. To help agencies select the most effective countermeasure, two innovative evaluation of performance approaches were developed so they can be used to evaluate and compare among different advanced WWD countermeasures. These approaches consist of before-after analysis of WWD non-crash events (WWD 911 calls and citations) and turn around rates of wrong way vehicles to self-correct their WWD acts. With this research, transportation agencies can better predict WWD entries at exit ramps; identify suitable locations for possible countermeasures deployment; and improve their current design, signing, and pavement marking practices while still following national and state standards.

Bone adheres to what is called "Wolff's Law", meaning it is an adaptive structure which adjusts its geometry based on the loads experienced over its life. As the new femoral hip implant transmits reduced stresses to the remaining bone, bone tissue atrophies at the interface, permitting loosening of the implant, pain, and thereby obliging additional surgery to correct the issue. In the present work, a methodology is endeavored for creating an innovative design for femoral hip implants. The approach uncouples the finite element implant model from the bone model, in order to focus solely on expected behavior within the implant while considering the varying material behavior in unique directions and locations. The implant's internal geometry is optimized in order to better match typical, intact bone conditions. The eventual design reduces extreme changes in stresses within remnant bone such that the implant will remain implanted for greater periods of time without additional surgical attention.

Show moreThe gun control debate has been placed at the forefront of American politics, as some of the most deadly mass shootings have happened in the last year. Much of the research on the effectiveness of gun control laws have shown inconsistent results. The purpose of the study is to compare states with stricter gun laws to states with more lax laws. This in turn will allow policy makers to identify effective strategies to implement in states that are lacking effective laws. The study examined state gun laws for all 50 states using the Gifford's Law Center to Prevent Gun Violence. The laws that were examined in this study were background checks, license requirements, mental health reporting, wait periods, concealed carry requirements, open carry, disarming prohibited people, and disarming domestic abusers. The states were then given a letter grade based on the laws that they have implemented. The results show that many states have failed to implement any sort of laws that would take guns out of the hands or prevent prohibited people from accessing guns. This study helps identify what laws each state has implemented to control guns throughout their state. This is important because states that are lacking laws in any area can identify and implement effective strategies that other states have put in place.

Instead of the TV version of law enforcement(-)anecdotes of police chases and shoot outs(-)this thesis examines people on both sides of the yellow crimes scene tape as they face their own mortality and the gruesome truth of people's unabashed cruelty towards one another.These essays wrestle with such issues as the following: confronting my own perceived inadequacies while encountering the expectations of those whose ideas of police work come from shows such as SWAT, Law and Order, and NYPD Blue; balancing career and parenting in the aftermath of divorce and a loss of purpose; pursuing a career in law enforcement with the idea of serving the community; discovering that policing in real life is a direct contradiction to the celluloid heroes I grew up watching on television; staging an internal war and ultimately resolving to move past resentment and move forward with a new purpose.Unlike most true crime dramas, this collection does not promise a happily ever after. The results indicate that students do not have a full understanding of the role of a free-body diagram or its relationship to the system of equations that are generated as a result of the application of NewtonÃÂÃÂÃÂÃÂ's Second Law to the free-body diagram.

Show moreAs the beneficial aspects of computers become more apparent to the elderly population and the baby boom generation moves into later adulthood there is opportunity to increase performance for older computer users. Performance decrements that occur naturally to the motor skills of older adults have shown to have a negative effect on interactions with indirect-manipulation devices, such as computer mice (Murata & Iwase, 2005). Although, a mouse will always have the traits of an indirect-manipulation interaction, the inclusion of additional sensory feedback likely increases the saliency of the task to the real world resulting in increases in performance (Biocca et al., 2002). There is strong evidence for a bimodal advantage that is present in people of all ages; additionally there is also very strong evidence that older adults are a group that uses extra sensory information to increase their everyday interactions with the environment (Cienkowski & Carney, 2002; Thompson & Malloy, 2004). This study examined the effects of having multimodal feedback (i.e., visual cues, auditory cues, and tactile cues) present during a target acquisition mouse task for young, middle-aged, and older experienced computer users. This research examined the performance and subjective attitudes when performing a mouse based pointing task when different combinations of the modalities were present. The inclusion of audio or tactile cues during the task had the largest positive effect on performance, resulting in significantly quicker task completion for all of the computer users. The presence of audio or tactile cues increased performance for all of the age groups; however the performance of the older adults tended to be positively influenced more than the other age groups due the inclusion of these modalities. Additionally, the presence of visual cues did not have as strong of an effect on overall performance in comparison to the other modalities. Although the presence of audio and tactile feedback both increased performance there was evidence of a speed accuracy trade-off. Both the audio and tactile conditions resulted in a significantly higher number of misses in comparison to having no additional cues or visual cues present. So, while the presence of audio and tactile feedback improved the speed at which the task could be completed this occurred due to a sacrifice in accuracy. Additionally, this study shows strong evidence that audio and tactile cues are undesirable to computer users. The findings of this research are important to consider prior to adding extra sensory modalities to any type of user interface. The idea that additional feedback is always better may not always hold true if the feedback is found to be distracting, annoying, or negatively affects accuracy, as was found in this study with audio and tactile cues.

Show moreCopyright law, in general, is a multi-faceted and sometimes difficult to understand process. Although it is law, it is often not straight-forward and cannot be applied universally. While the concepts of copyright infringement and plagiarism may sometimes overlap, many confuse one for the other or think they are the same offense. This thesis is intended to serve as a primer to some basic aspects of copyright law for technical communicators, including issues surrounding public domain works, the fair use doctrine, the copyright clearance process, as well as why we should be concerned about our current copyright laws.Over the past few decades, Congress has increased the number of copyright extensions, and these extensions are pushing out works that were to expire into the public domain. This thesis provides details about the growing copyright reform movement to explore the possibilities of making our culture more egalitarian and democratic when it comes to the exchange of ideas and information. Those who support copyright reform believe current copyright laws increasingly favor corporations and special interest groups rather than the public, and insist on a balance in copyright laws to loosen some of the restrictions.This thesis illustrates the importance of the knowledge of copyright and its associated laws for technical communicators especially in these current times. With the growth of the Internet within the last 20 years, some of the core concepts of how copyright works for the analog age present some challenges when translated into our digital age. Young professionals (-) particularly those working in web-based media (-) are faced with some contradicting ideas on copyright, sharing, and piracy, especially when surrounded by peers who perpetuate incorrect notions about these topics. Technical communicators also need to be aware of the risks they run if they choose to ignore the law (or choose to remain ignorant of it), but, on a deeper level, they also need be prepared to deal with the philosophical and ethical inquiries that tie into the concept of copyright. This thesis also provides practical applications of the knowledge of copyright laws for technical communicators.

The reasons for this have not been completely elucidated within the research lit-erature; however, it is thought that age related movement differences are due to at least one of three possible reasons. The current study investigated the influence of these three hypotheses: (1) biomechanical changes (limbs, joints, or muscles), (2) sensory feedback processing ability, or (3) differences in overall movement strategy on movement kinematics. Additionally, physical activi-ty is known to improve both physical and cognitive functioning and staying cognitively active may also attenuate age-related declines in cognitive ability; thus the current study also examined the impact of physical and mental fitness on movement performance across the lifespan. Both active and sedentary young and old adults completed different experimental conditions to de-termine how biomechanical ability, sensory processing ability, and individual differences impact different kinematic aspects of movement performance. Participants completed two different Fitts' pointing tasks where difficulty was manipulated by either increasing biomechanical effort and/or amount of feedback processing needed to complete each movement. Results indicated that distance impacted movement more than width for all participants indicated by a greater ID-MT slope. While increasing age was associated with an increases slope, the larger finding was that age increased the overall time. Thus, it was concluded that distance and width constraints are processed by similar processes regardless of age, but these processes slow with age. Cardio-vascular fitness attenuated declines in the distance condition while mental fitness attenuated those in the width condition. Further supporting a theory of differential movement constraints.

In 2018 a U.S. citizen was released after being held for 13 months as an enemy combatant. He was detained without being charged with a crime and without the ability to challenge the legality of his detention. This thesis serves two purposes. First, it will seek to trace the history of the term enemy combatant and highlight the evolution of its use by the executive branch. This thesis then examines whether the executive has exceeded his constitutional authority to classify a United States citizen as an enemy combatant. While most of the literature focuses on the treatment and detention of enemy combatants, existing scholarship largely overlooks the issue of authority to classify enemy combatants. This thesis will argue that the executive is overstepping the boundaries of its presidential power when the executive branch creates the criteria (a legislative function) for enemy combatants and applies the criteria in the classification of enemy combatants (a judicial function). This qualitative study will use normative legal research focusing on the principles of the law in classifying a suspected terrorist as an enemy combatant as well as the legal history of the term. The analysis of the legal history of the term enemy combatant will be completed by content analysis using Nvivo 12 software of various government documents as well as case studies of enemy combatant cases.

Marriage is a relationship that most American citizens are entitled to although it is not yet a fundamental right. As of a very recent court decision, Strawser v. Strange, Civil Action No. 14-0424-CG-C finalized on February 9, 2015, Alabama has legalized same-sex marriage; furthermore, thirty-seven states now recognize the legality of same-sex marriage. Marriage, whether it is between a heterosexual or a homosexual couple, should be a fundamental right enjoyed by all. This thesis will explain why same-sex marriage should be a fundamental right. The research presented in this thesis will be scrutinized and thoroughly examined showing the obstacles that same-sex couples face when wanting to legally marry. The United States Constitution, the Due Process Clause, and the Equal Protection Clause will be analyzed and discussed to prove that all fifty states should allow same-sex couples to wed. Citizens view what constitutes a marriage differently depending on their upbringing and residence. This thesis will illustrate why same-sex marriage has been such a widely discussed topic, and it will investigate the influence of religion and the church. Historically, the tradition of marriage has always been between one man and one woman. By examining how the tradition of marriage is changing and using case law decisions, an argument can be formed that marriage should be a fundamental right for all people.

Show moreThe existence of the oath in the courtroom can be traced back thousands of years throughout history, but the use, meaning, and effect of the oath in law has changed dramatically. The oath as we know it was once a powerful truth-telling instrument that our ancestors used to call upon a higher power. It was the belief of many that the oath itself was not sworn to man or state, but rather directly to a deity. The oath has since then evolved as a result of ever changing beliefs, fueled by increasing tolerance, shaping the oath into more of a tradition, and less of an edict. For centuries, theorists have attempted to determine whether an oath in court is actually effective at accomplishing its goal. The intent of this thesis is to examine the origin of the oath all the way up to the present day. It will be through a comprehensive study of federal law, state law, case law, articles, and publications that we will better understand the oath as a truth-telling instrument that in recent times has lost its effect. From there, it will be possible to better form a solution to a problem that plagues our courtrooms: perjury, or the act of lying under oath. This thesis will seek to establish the best way for our community to actively work towards ensuring the integrity and effectiveness of our judicial system.

GENEX simultaneously achieves design specifications on miss distance and terminalmissile approach angle while also providing a design parameter that adjusts the aggressiveness ofthis approach angle. Encouraged by the applicability of this user parameter, GENEX-ITACG is anextension that allows a salvo of missiles to cooperatively achieve the same objectives of GENEXagainst a stationary target through the incorporation of a cooperative trajectory shaping guidancelaw called Impact Time and Angle Control Guidance (ITACG).ITACG allows a salvo of missile to simultaneously hit a stationary target at a prescribed impactangle and impact time. This predetermined impact time is what allows each missile involvedin the salvo attack to simultaneously arrived at the target with unique approach angles, whichgreatly increases the probability of success against well defended targets. GENEX-ITACG furtherincreases this probability of kill by allowing each missile to approach the target with a uniqueapproach angle rate through the use of a user design parameter.The incorporation of ITACG into GENEX is accomplished through the use of linear optimal controlby casting the cost function of GENEX into the formulation of ITACG. The feasibility GENEXITACGis demonstrated across three scenarios that demonstrate the ITACG portion of the guidancelaw, the GENEX portion of the guidance law, and finally the entirety of the guidance law. Theresults indicate that GENEX-ITACG is able to successfully guide a salvo of missiles to simultaneouslyhit a stationary target at a predefined terminal impact angle and impact time, while alsoallowing the user to adjust the aggressiveness of approach.

Show moreAnalyzing the effect of legislation in children's safety when they travel as motor-vehicle passengers and bicycle riders can allow us to evaluate the effectiveness in transportation policies. The Child Restraint Laws (CRL) and Bicycle Helmet Laws (BHL) were studied by analyzing the nationwide Fatality Analysis Reporting System (FARS) to estimate the fatality reduction as well as drivers' decisions to use Child Restraint Systems (CRS) and bicycle helmets respectively. Differences in legislation could have different effects on traffic fatalities. Therefore, this study presents multiple methodologies to study these effects. In the evaluation of traffic safety issues, several proven statistical models have shown to be effective at estimating risky factors that might influence crash prevention. These proven models and predictive data analysis guided the process to attempt different models, leading to the development of three specific models used in this study to best estimate the effectiveness of these laws. Then, it was found that legislation in Child Safety Policy has consequences in traffic fatalities. A negative binomial model was created to analyze the CRL influence at the state-level in fatal crashes involving children, and showed that legislating on CRS can reduce the number of fatalities by 29% for children aged 5 to 9. Additionally, at the drivers-level a logistic regression model with random effects was used to determine the significant variables that influence the driver's decision to restrain his/her child. Such variables include: driver's restraint use, road classification, weather condition, number of occupants in the vehicle, traffic violations and driver's and child's age. It was also shown that drivers from communities with deprived socio-economic status are less likely to use CRS. In the same way, a binary logistic regression model was developed to evaluate the effect of BHL in bicycle helmet-use. Findings from this model show that bicyclists from states with the BHL are 236 times more likely to wear a helmet compared to those from states without the BHL. Moreover, the bicyclist's age, gender, education, and income level also influences bicycle helmet use. Both studies suggest that enacting CRL and BHL at the state-level for the studied age groups can be combined with education, safety promotion, enforcement, and program evaluation as proven countermeasures to increase children's traffic safety. This study evidenced that there is a lack of research in this field, especially when policy making requires having enough evidence to support the laws in order to not become an arbitrary legislation procedure affecting child's protection in the transportation system.

Show moreThe 2015 European Immigration Crisis brought an unprecedented number of immigrants to parts of Western Europe as millions of people fled war-torn and politically unstable countries. Similar to the increase in immigrants, Western European countries have also been combatting the rise of terror attacks throughout Europe. The increase in immigration coupled with an increase in terror attacks has caused anti-refugee sentiments among some Europeans and demands for stricter immigration policies. This paper examines how terrorism has impacted refugee and immigrant populations throughout Western Europe with a focus on Germany, France, and Belgium following the 2015 European Immigration Crisis. In order to determine the effects, the analysis focuses on recent terror attacks in the three nations. The claim that refugees are responsible for the increase in terror attacks is examined along with the impact of foreign terrorist fighters in each nation. Following this, the responses from right-wing groups are discussed. This includes the rise of right-wing political leaders, the organization of right-wing movements, and right-wing terror attacks. The resulting policy implications regarding both terrorism policies and immigration policies are also discussed. From these three areas of impact, the overall effects of the European Immigration Crisis are better understood.
