Interestingly, the 800 million people that are currently living on less than a dollar a day correlate very closely with the 750 million people who were under colonial subjugation in 1945. In an effort to understand how the disparities in development came about, the theory of self-determination will be defined and historically assessed. Through qualitative evaluation of the principle and history of self-determination and case studies on three key regions that have never known genuine self-rule, it will become clear that the doctrine of self-determination only ever existed in rhetoric. Resource trap theory will be applied to those who have been plagued by outside rule and a general assessment of the state of self-determination in the world will be given. Lastly, an argument for what right transcendently will be given based on the current state of affairs and on Kantian ethics.

Show moreABSTRACT Capital punishment is a forceful moral issue that is frequently overlooked. This is possibly due to the reverence many have toward the rule of law or a passive acceptance of the status quo. In this thesis I will begin with a discussion of context to the topic of the death penalty in order to address potential biases. Then I examine not only the ethical merit of the death penalty but the foundational justifications for a system of criminal justice to show that the special relationship between the state and its citizens does not lend itself to or allow for the instantiation of the death penalty. I look first to several theories of punishment selecting the most viable theory in order to make the most plausible case in favor of the death penalty. From there I establish that there is some intuitive merit to the notion that the vicious deserve unhappiness and see how far that intuition might extend. In this section I examine the merits and demerits of Kantian retributivism in order to address the many intricate ethical and political issues involved in the death penalty debate. I've chosen the Kantian ethical framework because of the nuance with which many of the problems of retribution are solved. Kant insets the enlightenment principles into his moral framework and provides reasoned explanations for there insistence, as such his work provides a background from which I will work through details and resolve contradictions. I will then make an argument for the moral personhood of the state and sketch the special relationship it has to its citizens. Finally I will offer a system that incorporates the ideas developed in the previous sections and gives a practical answer to the death penalty debate. It is my ultimate argument that there is no absolute ban on the death penalty, possibly even some intuitive merit to the scheme, but ultimately many moral limitations on its implementation.

Show moreThe use of reason appears to lead to divergent conclusions for what is right and what is good in human action. While reason is a central feature in ethical theory, there is a problem when that central feature does not lead to consistent conclusions about how to act in a given situation. Several philosophers have attempted to combine previous moral theories in order to provide a better template for human action. I contend that the use of reason is of vital import when determining the foundation for moral action and that moral theories, to be consistent with reason, should incorporate aspects of both non-consequentialist and consequentialist ethical theories. I argue that there is a unifying foundation presupposed by the moral theories of both Immanuel Kant and John Stuart Mill. Through the use of reason the theories of Kant and Mill can be reconciled to show that these theories can be combined when understanding the basic foundation that they share.

In opposition to totalizing structures of justice founded upon an ontological conception of community, Emmanuel Levinas conceives the possibility of a political or social structure of difference. I argue that the conceptions of community presented by Kant and Heidegger, either as a harmonious, unified being in common, or as a common-identity disclosed beneath the ontological horizon of being-with, necessarily leads to violence. This violence is reflected in the forms of justice instantiated by these philosophies, which privilege the 'light' of the universal over the particularity of individuals in the face-to-face encounter, ultimately corrupting and nullifying one's anarchic moral responsibility for the Other. The intent of this thesis is to argue that justice can only remain just if it is seen, not on the basis of a communal 'light' that absorbs, integrates, and incorporates the Other as an element of a system, but as founded on the anarchic responsibility of the one-for-the-Other. Justice, I will show, cannot be seen as an aim of a community—complete and self-sufficient—in achieving an end, but as a rupture, a disturbance, as a call made among a multitude of particular, unique Others by which ethics (the face-to-face) is fundamental.

Show moreIn geography, maps are a tool of placement which locate both the cartographer and the territory made cartographic. In order to place objects in space, the cartographer inserts his own judgment into the scheme of his design. During the Early Modern period, maps were no longer suspicious icons as they were in the Middle Ages and not yet products of science, but subjects of discourse and works of art. The image of a cartographer's territory depended on his vision�both the nature and placement of his gaze�and the product reflected that author's judgment. This is not a study of maps as such but of Early Modern literature, cartographic by nature�the observations of the author were the motif of its design. However, rather than concretize observational judgment through art, the Early Modern literature discussed asserts a reverse relation�the generation of the material which may be observed, the reality, by the views of authors. Spatiality is now an emerging philosophical field of study, taking root in the philosophy of Deleuze & Guattari. Using the notion prevalent in both Postmodern and Early Modern spatiality, which makes of perception a collective delusion with its roots in the critique of Kant, this thesis draws a through-line across time, as texts such as Robert Burton's An Anatomy of Melancholy, Thomas More's Utopia, and selections from William Shakespeare display a tendency to remove value from the standard of representation, to replace meaning with cognition and prioritize a view of views over an observable world. Only John Milton approaches perception as possibly referential to objective reality, by re-inserting his ability to observe and exist in that reality, in a corpus which becomes less generative simulations of material than concrete signposts to his judgment in the world.
