Show moreAccording to well-known political science professors in Florida universities, the only constitutional mandate to which the Florida Legislature must adhere is to pass a balanced budget (MacManus, Jewett, Bonanza, & Dye, 2015, p. 184). The process begins with each of Florida's state agencies crafting their individual budgets almost as soon as the new budget year takes effect (July 1). These budgets are submitted to the Governor's office where they are reviewed by staff and then ultimately submitted to the legislature (p. 243). During the budget process, legislators are careful to ensure that they procure state dollars, oftentimes referred to as "pork," for the constituents who elected them (p. 209). The premise of this paper is to explore the possibility that political influence or power has a direct effect on the amount of tax dollars appropriated to Florida's 67 counties, 10 media markets, and in turn to Florida's three geographic regions. First, a legislative power index is developed. We then analyze county by county allocations of budget year 2016/2017 and the legislative power index to determine if there is a relationship between the amount of money distributed by county and the legislative influence that exists in that county. The research finds that the legislative power of a county as measured by the legislative power index had no statistically significant effect on per capita allocation. The presence of a state university and miles of roadway in a county did have an influence.

Show moreThis research examines Senate Bill 744 (S.744) from the 113th Congress of the United States, and its findings will be used as a model to reveal problems in similar legislation. Senate Bill 744 was proposed by the 113th Congress in an attempt to accomplish bi-partisan immigration reform. The bill was viewed (and still is) as a comprehensive compromise, in that neither Democrats nor Republicans were completely satisfied with its result. The outcome was that the legislators who were involved in S.744's creation were satisfied that something on the topic of immigration reform had been accomplished (the bill passed the Senate, but never came up for a vote in the House), even if it was not what they, nor their constituents really wanted. S.744 addressed, what the researcher perceives, as the key Democratic and Republican issues concerning immigration reform in the United States, which were status for undocumented immigrants on the left, and increased border security on the right. However, the researcher also notes that neither of these issues were handled well in the bill because of their exclusionary nature, and that is what led her to this research. This study is important because it will highlight legislative failures and look at how representatives can be held more accountable for their use of disingenuous language. This research looks at aspects of identity and privilege as they relate to exclusions from the dominant culture, and consequently the legislative process. The researcher would like to disclose that as an immigrant herself she has first-hand experience of the system's failures, and is approaching this project with personal invested interested in the success of future legislation.

Show moreThe citizen legislator is both a controversial and recurring phenomenon of interest in political science research. A longstanding concern for the discipline has been whether or not involvement of the public in the lawmaking process is an asset or a liability to quality governance. This study explores the desirability of citizen legislating in the American states. A four dimensional index is created that includes empirical indicators of "substantive" and "procedural" governance. These indicators include voter turnout, fiscal health, the ideological distance between government and the citizenry, and the diversity of a state's interest group system. The total number of initiatives and popular referendums that appear biennially within each of the fifty states is employed as the key explanatory variable to capture the degree of citizen legislating that is occurring in the states between 1980 and 2000. A random-effects generalized least squares regression reveals that higher ballot measure counts are statistically and substantively associated with better quality governance, indicating that citizen legislation is a quality input into the political system. Key control variables such as divided government, interparty competition, citizen ideological extremism, state legislative term limits, and legislative professionalism also tell particularly poignant stories about the road to good governance.

Show moreThe purpose of this research is to examine the legislative process that led to the Imported Vehicle Safety Compliance Act of 1988. This research will look at the original intent of the law, as well as its possible irrelevance today. This research will compare the environment that existed during its creation, and compare it to the drastically different landscape that exists now in the new car market. From this comparison, this paper will recommend a route for the United States to better open trade with other countries and allow more consumer freedom. This research will look at the Imported Vehicle Safety Compliance Act from a political science viewpoint. This analysis will take into consideration the legislative process that led to this act and show that it is an example of the legislative process helping large companies while hurting ordinary consumers. The history of this legislation will show that the justification presented represents protecting consumers from a harmful product. However, the recent history will reveal a government that is quick to make assumptions without regard to facts that disprove the reasoning for this act. This research will seek to use the Imported Vehicle Safety Compliance Act as example of a law that is in need of an update, but has not had any meaningful reform. The goal of this research will be to illustrate why laws that are no longer effective remain without reform.

Show moreThe focus of this study was to ascertain what, if any, were the commonalities and differences between and among bully-suicide victims between the ages of nine and eighteen. The focus of this study additionally was to determine to what extent, if any, was there a relationship between parent advocacy, media coverage, and/or a social event related to bully-suicide and the implementation or amending of state anti-bullying legislation. Bully-suicide victims (N = 92) from throughout the United States whose information was available through Internet search engines were included in this study. Further, state legislators (N = 50) who sponsored their states most recent anti-bullying legislation also were included. State legislators who provided direct responses to the request to participate answered four interview questions regarding their sponsorship of anti-bullying legislation. Commonalities between bully-suicide victims were analyzed to determine if particular demographics had an equal likelihood of occurrence. Legislator responses to the interview questions were analyzed for themes using a phenomenological research method.Through an examination of the research results and related literature, the researcher determined that there was a statistically significant deviation from equal likelihood of groups for bully-suicide victims who were male, high school-aged, or targeted due to appearance or sexual orientation. Further, bully-suicide victims were most frequently subjected to verbal bullying. Evaluation of the data also unveiled that parent advocacy, media coverage and social events related to bully-suicide were related to state legislator sponsorship of anti-bullying legislation.

Show moreThis research seeks to determine the relationships between the quality of physical education (PE) programs provided by state departments of education (DOE), obesity rates, and sedentary behaviors described as physical inactivity in adolescents ages 10-17 years old. A modified rubric based on the "Let's Move Active Schools Assessment" was created and used to quantitatively and qualitatively evaluate the PE programs and physical activity (PA) opportunities provided by websites of the state's DOE. A total of fourteen states were chosen to be assessed due to having either the highest or lowest obesity or physical inactivity rates. It was believed that the states with the highest obesity prevalence would have the highest inactivity and the lowest quality PE programs, and that those with lowest obesity prevalence would have lowest physical inactivity and high quality PE programs. After assessing the chosen states, no correlation was found between the quality of PE program as determined from the created rubric and the obesity or sedentary behavior rates of the state. The highest grade of all states assessed was 23 out of 27 with the lowest score being 7. The average scores of the states with the highest obesity was greater than the average for those states with the lowest inactivity, indicating that the quality of PE programs as provided by the DOE are not exclusively related to obesity and physical inactivity prevalence. Other determining factors such as nutrition, state funding, local policies, and societal factors may be more involved in the health of children than what is popularly believed. The data show that efforts are being made to decrease obesity throughout schools and the departments of education, however the efficiency of such efforts to increase physical activity and health are low. While states may post plans for PE and create standards for teaching, local levels of education are not required to enforce the policies or teach the curriculum suggested. Including students with special conditions and providing physical activities outside the school building is also lacking although it may seem like measures are being taken to provide such opportunities. More evaluations must be completed to get a stronger understanding of how to fix inadequate physical education and activity programs provided by the states' DOEs. Reviewing each DOE efforts as well as that of the community and individual school districts would help gain insight into where roadblocks reside and how to overcome destructive policies to offer better physical activity and education to children.

Show moreThis study examined the legal, statutory, and governance issues facing virtual charter schools. Virtual models of schooling have the potential to change the face of public education as such schools challenge traditional forms of education. Legislators, policy makers, and school boards must carefully consider existing charter school legislation and determine whether such language is applicable to virtual charter school models. As virtual forms of schooling increase, and choice options for parents become more readily available, the challenge is to develop statutory language that is not overly restrictive but provides a framework from which authorizers and governing boards may operate to ensure the quality, equity, and fiscal responsibility of virtual charter schools. The focus of the study was on the existing legislation in the 19 states with current virtual charter school statutes. The qualitative examination of case law, combined with a review of statutory language, provided the sources of data. Recommendations for policymakers, legislators, departments of education, and school boards were developed to ensure the instructional quality control, the compliance with state and federal statute, and the financial security of virtual charter schools. In an era where choice in education has become mainstream, monitoring the quality of choice options becomes paramount. The development of policies and laws relative to the careful operation of virtual charter schools, from authorization, to governance, to appropriate funding is in the purview of the state. Case law developed in states such as Pennsylvania and Wisconsin where the legality of virtual charter schools has been challenged provides the legal standards for other state legislatures. The establishment of carefully worded legislation that addresses the issues inherent in the next version of school choice is critical to the successful operation of virtual charter schools. Oversight for funding, attendance, curriculum and instruction, and teacher certification is critical in both the authorizing and governance of such schools. Legislation that details the process for enrolling district and out of district students, the process for how the funding flows from the state, to the district, to the virtual charter school, and how the students will be counted for accountability purposes is critical to the successful implementation of virtual charter schools.

For this reason, prospective parents are taking notice of the trend. Currently, federal and state statutes are set up to promote the introduction of cord blood use. What current law fails to recognize is that cord blood is in use and has a lot of potential. For this reason laws need to be updated to better reflect the current market. A more proactive approach needs to be taken to better utilize the potential of cord blood. As the trend is popularized there is an increasing notion that informed consent is not uniform enough, state laws do not adequately promote cord blood use, and there is a discrepancy between the standards of public and private cord blood banks. In order to improve upon these issues it is necessary to review the laws that are currently in place and then expand upon them so that they better reflect the storage, use, and donation of the blood. If umbilical cord blood becomes more than medical waste, as is projected to happen, then there is a need for an adequate legal foundation that protects the interests of all parties involved, especially prospective parents.

Show moreThe purposes of the following thesis is to research United States Supreme Court sex-discrimination jurisprudence and ascertain if Fourteenth Amendment legislative history was used, referred to, cited to, or quoted from, by the Supreme Court Justices in their opinions regarding sex-discrimination cases since the Amendment was ratified in 1868. Legislative history is a window into the drafting, debating, and intricate crafting of laws and amendments. When words and phrases that are used in the statutes, codes, and amendments are ambiguous or unclear, judges and justices should use the legislative history to ascertain the intent of the framers of the legislation. The methodology that was employed for this thesis was through the researching of all relevant United States Supreme Court cases as to what was written by the Justices in their opinions. Research was conducted into the relevant law review articles on the subject of legislative history of the Fourteenth Amendment, Supreme Court sex-discrimination jurisprudence, and the historical impact of Court decisions on the law relative to sex-discrimination. After extensive research, it was discovered that the United States Supreme Court has established over 144 years' worth of sex-discrimination jurisprudence. The law review article research revealed that the lack of legislative history research by the Court has not gone unnoticed by the legal community or the women's rights community since the Fourteenth Amendment was originally drafted. The research and analysis of the sources of sex-discrimination from cases, law review articles, and books on the subject, led to the conclusion that no Fourteenth Amendment legislative history was ever used by the Supreme Court of the United States as part of its development of sex-discrimination jurisprudence.

Show moreWith mass shootings occurring with frightening regularity, research into gun ownership behavior is becoming increasingly important for public policy creation and public safety. While extant research tells us that firearm ownership is woven deep into the historical fabric of American culture, scholarship has yet to fully explore predictors for gun ownership. Employing 2015 Pew Research Center political survey data, this study examines the predictive effects of birth cohort, political ideology, and attitudes towards gun control legislation on gun ownership, with and without controls, using hierarchical binary logistic regression models. The presented models examine three separate cohorts: The Millennials, Generation X, and the Baby Boomers. Findings reveal that Millennials, liberal political ideology, attitudes which stress the importance of controlling, as opposed to protecting, gun ownership are significantly less likely to own a firearm. Furthermore, gender, household income, population density, southern residency, and race were also found to significantly influence gun ownership. Implications, limitations, and recommendations for future research are also discussed. While this research cannot perfectly predict individual gun ownership, it does effectively highlight several important facts to consider. From the fog of media speculation, political grandstanding, and overly simplistic and unwarranted assumptions, the results of this study bring into full view the inherent complexity of American gun ownership.

In order to study charter school legislation and litigation, all of the United States charter school legislation was collected along with American court cases related to charter schools and charter legislation. Legislation was reviewed to identify similarities and differences in funding, accountability and governance provisions throughout America. Court cases, involving charter schools and charter school legislation, were reviewed to identify the types of issues being litigated and the resulting legal decisions.

The methodology for this research includes the analysis and comparison of certain variables, including public opinion, budgetary constraints, and the relative majority of the party that holds power in one or both chambers, and the ways these variables may impact the behavior of the legislative branch in this regard. It also includes the analysis of appropriations requests made by the legislative branch for funding military engagement in rejection of requests from the executive branch for all military engagements that occurred during periods of divided government from 1946 through 2009.

Both the anti-terror legislation and the history of terrorist incidents will be researched within the time period of 1980 to 2009, a 30 year span. This thesis will seek to establish a relationship between the occurrence of terrorist events and when states change their anti-terror legislation. Legislation enacted can vary greatly. Common changes in legislation seek to undercut the financing of terrorist organizations, criminalize behaviors, or empower state surveillance capabilities. A quantitative analysis will be performed to establish a relationship between terrorist attacks and legislative changes. A qualitative discussion will follow to analyze specific anti-terror legislation passed by states in response to terrorist events.

Show moreObesity is one of the major public health issues in the United States, often regarded as part of a global crisis. Companies invest billions of dollars each year towards television advertising campaigns aimed at convincing audiences how their ground-breaking discovery 'battles the bulge' or somehow offers an increased health benefit. This study examined how advertisers presented health-related claims, including health and nutrient-content claims, in U.S. adult-targeted television food commercials. The claims were compared to FTC, FDA, and USDA laws, regulations, and recommendations. A content analysis of food advertising was conducted of commercials from major and cable network programs broadcast during prime-time in the first quarter of 2009. The majority of claims match current regulations when compared to Federal references. The results show that Nutrient and Wellness claims were the most frequently cited. The type of benefit, Healthy Eating, emerged almost 3 times more than any other benefit type. This is also similar to those results which suggest advertisers' intentions were to promote overall wellness in their content delivery. As such, the Wellness Approach was identified and conceptualized, leading towards full development of a Wellness Effect theory. Implications and future research opportunities are discussed on both a theoretical and practical level.

Show moreFollowing the historic election of Barack Obama, the largest overhaul of the nation's health care system since the Great Society, and with the country still reeling from the worst economic downturn since the Great Depression, a group of disenchanted conservative Republicans and elected leaders wary of government policy gave rise to a new political movement (-) the Tea Party. Since taking the American political system by storm in 2010, considerable research has focused on the electoral consequences of the Tea Party. Using an original dataset and the American National Election Study, I study the Tea Party Caucus at the elite level by analyzing roll call votes, incumbency, and endorsements, and at the mass level through an examination of congressional districts and constituencies. Findings show that members of the Tea Party Caucus and their Republican House colleagues are largely homogeneous. Exceptions to this include economic final passage votes, legislation receiving presidential support, district lean, census region, and presidential vote in congressional districts. Furthermore, evidence is seen that economic factors in members' districts affected the election of freshmen representatives in 2010, and that district variables strongly influence legislative voting behavior. Finally, discontinuity is discovered between the Tea Party movement at the mass level and the Tea Party Caucus at the elite level.
